OFFICIAL RULES

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. 

1. Sweepstakes Period: These Official Rules apply to the Anytime Fitness “Just Heard Anytime”  Sweepstakes (“Sweepstakes”). The Sweepstakes begins at 6:00 p.m. ET on February 12, 2023 and ends one(1) hour after the game is declared officially over or 12:00 midnight ET, whichever occurs later, on February 12, 2023 (“Sweepstakes Period”). 

2. Eligibility: The Sweepstakes is open only to legal residents of the United States and Canada (except the Province of Quebec) who are at least eighteen (18) years of age at the time of entry. Not open to employees and their families (spouses, parents, children/siblings and their respective spouses, and those living in the same household) of Anytime Fitness Franchisor, LLC (“Sponsor”), their subsidiaries, affiliates, agents, franchisees, retailers, promotion partners, and advertising and production agencies, and PROMOSIS, INC. (“Administrator”). Participation constitutes entrant’s full and unconditional agreement to these Official Rules and to Sponsor’s and Administrator’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein. Sponsor reserves the right to verify the eligibility of winners.

3. To Enter: Post the hashtag #JustHeardAnytime on Twitter or Instagram, whenever the word “anytime” is uttered or shown on screen in “live” real time during this year’s big game television broadcast during the Sweepstakes Period, including commercials and halftime performances. Posts must be made within ten (10) minutes of the word being spoken or shown. In the event that the word “anytime” is not uttered or shown on screen in “live” real time by the conclusion of the big game television broadcast, participants may enter as outlined above, any time before the Sweepstakes Period deadline. Entrants are required to have a Twitter or Instagram account, available for free sign up at twitter.com and instagram.com. Entrant’s social media account must be set to “public” in order for the entry to be eligible; account can be returned to “private” any time after winners have been determined. Limit one (1) entry per person/account per mention or appearance of the word “anytime”. Multiple entries, beyond what’s specified above, from any person or account will be disqualified. Entries must be complete to be eligible. Social media posts must comply with all terms and community guidelines associated with the applicable social media platform. The following guidelines should be followed when submitting a social media post.

Social media posts may not:
include any content that may be deemed obscene, violent, or offensive
infringe on the privacy of any person other than an entrant
communicate messages or images inconsistent with the positive image and good will of the Anytime Fitness brand

Any entries that contain, depict, or show such content as defined above and/or that violate these requirements and/or the terms of these Official Rules will be disqualified. The Sponsor reserves the right in its sole and unfettered discretion to disqualify any entry that they believe is inappropriate or not suitable for publication, that does not comply with these Official Rules, or that is not consistent with the spirit or theme of the Sweepstakes.

Sponsor and its promotion partners reserve the right to publish any submitted entries, in full or in part, in any and all media. Publication of an entry is not intended to indicate that the entry has been selected as a prize winner or is favored in any way. All entries become the property of the Sponsor and will not be acknowledged. By submitting an entry, entrant explicitly acknowledges and agrees that the Sponsor and its promotion partners, legal representatives, successors and assigns shall have the irrevocable, worldwide right in perpetuity to license, sub-license, edit, alter, post, reproduce, publicly display and publish, in any media, including online, any or all material which you post to Twitter or Instagram in connection with this Sweepstakes, without any additional consideration or approvals from or to entrant. In the event of a dispute regarding the identity of any entrant, the entry will be deemed made by the person identified as the authorized account holder of the social media platform handle associated with the entry. All online entries must be submitted and received by the deadline of the Sweepstakes Period, as defined above. Sweepstakes is void where prohibited, and is subject to all applicable laws and regulations. Participants consent to the use of their entries and registration information in accordance with the Anytime Fitness privacy policy. All federal, state, provincial, and local laws and regulations apply. Entrants agree to the release of their name, address, and email information to Sponsor and Administrator for winner notification purposes and for public winner disclosure, as required by law.

4. Drawings and Winner Notification: Potential winners will be selected via random drawings from among all eligible entries received by the deadline. Drawings will be conducted on or around February 16, 2023 by PROMOSIS, Inc., whose decisions will be final and binding in all matters relating to this Sweepstakes. Potential winners will be notified via social media direct message from Sponsor, and will be required to complete an online winner verification within three (3) days of the date of the notification, or prize will be forfeited. Potential winners may be required to upload a “selfie” photo and image of a government-issued photo ID, as part of the online verification. Entrant’s social media account must be set to receive direct messages from anyone in order to be notified. Potential winners who are residents of Canada will be required to correctly answer a skill-testing question to be eligible for prize award, in accordance with Canadian law. Any potential winner who fails to complete the winner verification or is found to be ineligible will be disqualified, and an alternate winner will be randomly selected from the remaining pool of participants received for the original drawing. A selected potential winner will not be an official winner until eligibility has been formally verified by Sponsor. Sponsor is not responsible for fraudulent communications made to entrants or potential winners. Odds of winning a prize are dependent upon the number of eligible entries received. 

5. Prizes: One (1) Grand Prize: a trip for two (2) to an Anytime Fitness location of the winner’s choice, including round trip Coach Class air travel for two (2) from the major gateway airport nearest the winner’s home, seven (7) nights accommodations (one room, double occupancy), $1,500 for ground transportation and meals, plus a seven (7) day pass for two (2) to the local Anytime Fitness gym. Approximate retail value of Grand Prize = $20,000. Actual value may vary based on timing of trip, location of departure and destination cities, and assessment of prize elements publicly available. Difference between actual value and stated value, if any, will not be awarded in cash or other consideration. 

Fifty (50) First Prizes: a one (1) year membership to an Anytime Fitness gym near the winner’s home, within the US and Canada. Approximate retail value of each First Prize = $540. 

Total approximate retail value of all prizes = $47,000.

Grand Prize elements, including air travel provider and hotel, will be chosen by Sponsor. Grand Prize winner is responsible for any incidental travel costs not expressly stated above, including but not limited to transportation to/from airport in departure city, passenger tariffs or duties, surcharges, airport fees, service charges or facility charges, personal charges at lodging or gym venue, or other expenses. Any other costs associated with the Grand Prize trip are at the winner’s discretion, and are not included. Grand Prize trip must be scheduled and completed by February 12, 2024, subject to change at Sponsor’s discretion. Grand Prize winner and trip guest must be available to travel by the date specified, or prize and its value will be forfeited. Grand Prize winner’s trip guest must be eighteen (18) years of age or older. Travel guest of the winner will be required to complete a liability/publicity release (where permitted by law) before trip is booked. Winner and guest must travel together on the same itinerary, and are solely responsible for obtaining any and all required travel documentation. If the Grand Prize winner elects to travel or partake in the prize without a guest, no additional compensation will be awarded to the winner. Prize trip and its components are subject to scheduling availability and certain other restrictions. Sponsor will not be responsible for replacement of any lost or stolen tickets or travel vouchers once they are in winner's possession or in the possession of the winner’s guest. Sponsor is not responsible for any postponement, delays, or cancellation of air travel in connection with the prize trip or any postponement, delays, or cancellation of event, due to COVID-19 or other reasons. Should any event, element, or detail of a prize become unavailable, the Sponsor shall have no obligation to the winner aside from providing the remaining portion of the prize, minus any unavailable event, element, or detail. Grand Prize gym passes are subject to the terms and conditions specified by Anytime Fitness. Grand Prize winner and guest must comply with all venue regulations or that portion of the prize may be forfeited. Winners are solely responsible for all applicable taxes on the value of the prize. Grand Prize winner will be issued an IRS 1099-MISC tax form (or the Canadian equivalent) for the retail value of the prize awarded. Limit one (1) prize per person. Winners must comply with all Anytime Fitness member policies. Prizes may not be transferred, assigned, or redeemed for cash, in whole or in part. No substitution for prizes or parts thereof, except by Sponsor as may be necessary due to unavailability. If originally-offered prize or prize element is unavailable at the time of award, Sponsor may substitute an item of comparable or additional value. Memberships at specific gym locations are subject to availability. Winner must sign a membership agreement and liability waiver for the specific gym. No more than the stated number of prizes will be awarded. By accepting a prize, winner agrees to grant to the Sponsor and its promotion partners the right without limitation to use the winner’s name, picture, portrait or likeness, and voice in any future promotional material in any and all media, now known or hereafter devised, without further compensation, where permitted, and that such use can be made without prior inspection or approval of the use of any copy used in connection with it. 

6. Limitation of Liability: Sponsor and its promotion partners and affiliates are not responsible for typographical errors in any Sweepstakes-related materials; for lost, late, misdirected, or incomplete entries or email; for technical, hardware, software, Internet, or telephone failures of any kind; for lost or unavailable network connections; for viruses; for failed, incomplete, garbled, or delayed computer transmissions that may limit or interfere with a participant’s ability to take part in the Sweepstakes; or for non-delivery of any prize due to factors beyond Sponsor’s control, including lost, late, or misdirected deliveries or any delay or suspension of service that may affect prize delivery. Entries generated by script, macro, or other automated entry devices are not valid and will be disqualified. Sponsor reserves the right to disqualify and seek prosecution of any entrant who disrupts or interferes with the proper play of the Sweepstakes, or acts in violation of these Official Rules in any way. Sponsor reserves the right to cancel or modify Sweepstakes if fraud or technical failure compromises the integrity of the Sweepstakes, or corrupts or impairs the administration, security, fairness, or proper play of the Sweepstakes, as determined by Sponsor in its sole discretion. If Sweepstakes is canceled for any reason, including but not limited to those stated above, winners will be determined via random drawings from among all eligible entries received up to the time of cancellation, and the potential maximum number of prizes offered will be awarded. Sponsor and its promotion partners, related companies, agencies, and their respective employees or officers shall not be liable for injury, losses, damages, or costs of any kind resulting from participation in this Sweepstakes, or acceptance of or use or misuse of a prize or parts thereof. This promotion is in no way sponsored, endorsed, or administered by Twitter or Instagram, nor are these entities responsible for prize awards. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

7. Dispute Resolution: THIS SWEEPSTAKES IS GOVERNED BY THE LAWS OF THE COMMONWEALTH OF MASSACHUSETTS, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Sweepstakes, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Massachusetts having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participants' actual out-of-pocket expenses (i.e. costs associated with entering this Sweepstakes), and participant further waives all rights to have damages multiplied or increased.

8. Winners List: For the names of the winners, available until May 12, 2023, send a standard-size postcard, only, with your name and address to: Anytime Fitness “Just Heard Anytime” Sweepstakes Winners List, P.O. Box 38, Marblehead, MA  01945. Do not send any other correspondence to this address.
